Conditions of use and terms of practice.

BoulderForest Terms of Use, Risk Acknowledgment and Liability Waiver

A. Adherence to Terms

Anyone wishing to access the sports facilities of BoulderWorld SARL (hereinafter referred to “BoulderForest”) undertakes to comply with BoulderForest’s internal regulations. This internal regulation must be signed by the User before using the sports facilities. Non-compliance with this regulation may result in a ban from the premises. The User's signature on this regulation constitutes confirmation of reading and acceptance of the stated terms. For minors, a legal guardian must also sign the internal regulations.

B. Use of Sports Facilities

1. The use of the BoulderForest sports complex is subject to a fee.
2. Use of BoulderForest sports facilities is at the User’s own risk. The User acknowledges that bouldering and related activities involve inherent risks, including falls, collisions, and improper use of equipment. The User accepts these inherent risks.
3. To the fullest extent permitted by Luxembourg law, BoulderForest shall not be liable for damages resulting from such inherent risks or from the User’s own actions or those of other users.
4. Nothing in these terms excludes or limits liability for gross negligence, willful misconduct, or any liability which cannot be excluded under applicable law, including defects in the installation or failure to ensure a minimum level of safety of the premises.
5. The use of sports facilities (Bloc, Fitrack, children's area, etc.) is allowed only after registration and signing of the internal regulations.
6. By signing, the User acknowledges the risks of injuries inherent in various activities and accepts these risks.
7. The use of sports facilities (Bloc, Fitrack, children's area, etc.) is permitted only for individuals holding a valid entry pass and is at their own risk. The User must, at any time and upon request from the staff, provide proof of a valid entry pass.
8. Access and use of sports facilities are strictly reserved for individuals with the necessary knowledge and skills for the different activities. Access to the Bouldering Zone is reserved for Users who have sufficient experience and understanding of bouldering safety principles.
9. BoulderForest does not systematically assess the competence of Users. However, it provides general safety instructions and may intervene where unsafe behaviour is observed. BoulderForestThe User is solely responsible for ensuring that they possess the necessary skills to practice safely.
10. The User confirms that they have no physical or medical contraindications to participating in the various activities offered by BoulderForest. The User confirms that they are physically and medically fit to participate. The User remains solely responsible for assessing their fitness and seeking medical advice where appropriate.
11. Users are responsible for ensuring that their physical condition allows them to participate safely in climbing and other activities at BoulderForest. Users with any medical condition, injury, or other health concern that may affect their ability to participate safely are advised to seek appropriate medical advice before participating.
12. Activities such as bouldering, and calisthenics involve a high risk of falls and injuries. The User agrees not to take unnecessary risks and not to exceed their limits. These activities require great responsibility from the User. The User commits to do their best to avoid uncontrolled falls.
13. Users are prohibited and should refrain from wearing climbing shoes in restricted areas such as toilets for hygiene and safety reasons.
14. Only climbing shoes are allowed on climbing mats. Climbing barefoot or with socks only is not allowed.
15. First-time Users are required to attend a brief, complimentary safety and orientation briefing before climbing for the first time. The briefing shall be conducted by BoulderForest staff.
16. BoulderForest may require any User to attend an additional safety briefing if they fail to respect the applicable safety rules or staff instructions.‍

C. Zoning & Access Restrictions

1. BoulderForest operates with clearly designated zones.
2. The Bouldering Zone (12+) is accessible only to Users aged 12 years and above.
3. The Adventure Zone is open to children under 12 and their accompanying adults, as well as Users of all ages.
4. Children under 12 are strictly prohibited from entering or using the Bouldering Zone.
5. Users aged 12 and above may access the Bouldering Zone after initial registration and safety briefing.
6. Adults accompanying children must remain within the Adventure Zone unless climbing independently.
7. All Users must respect zoning signage and follow instructions from staff at all times.
8. BoulderForest reserves the right to remove any User from a zone if these rules are not respected.‍

D. Responsibilities and Instructions

1. Instructions from BoulderForest staff must always be followed.
2. To the fullest extent permitted by the law, BoulderForest shall not be held liable for theft, loss, or damage to personal belongings incurred on the premises, including but not limited to the following areas: the locker rooms, toilets and adjacent parking lot.
3. Access to emergency exits must be kept clear at all times.
4. BoulderForest relies entirely on the User’s declarations regarding their level of experience and competence and does not systematically verify such competence. The User confirms that they possess the necessary knowledge and skills to safely participate and accepts full responsibility for their use of the facilities.
5. It is forbidden to practice the various activities and use the various facilities under the influence of alcohol and/or other narcotics.
6. Alcohol consumption is only allowed after the sessions of the various activities.
7. The different entrance fees are displayed on the price list at the counter and on BoulderForest’s website. BoulderForest reserves the right to change these fees. Any change in fees does not apply to the validity period of subscriptions.
8. Partial and temporary closure of different sectors is possible due to restructuring of boulders. Any right to compensation is excluded.
9. Priority should be given to children's birthdays in selected areas.
10. Registration and/or reservation of classes, rooms, and events (teambuilding, birthday party, etc.) are binding. Any cancellation must be notified by email.
    

E. Terms of Usage Specific to Bouldering Sections

1. Access to the climbing walls and on the climbing mats is strictly reserved for climbers and spotters. Unnecessary presence on the climbing mats is prohibited.
2. Only climbing shoes are allowed on climbing mats. Climbing barefoot or with socks only is not allowed.
3. Only water consumption is allowed in the climbing areas. Purchased foods and beverages must be consumed in the designated areas. No outside foods allowed.
4. Climbing below or above another person on the climbing walls is strictly prohibited. A safety distance of 3 meters on the wall must be maintained at all times.
5. Before climbing, a climber should read the route carefully, ensure that the area is clear and that he or she can maintain a safe distance of 3 meters from other climbers.
6. Passing beneath or within the fall zone of a climbing wall while another person is climbing is strictly prohibited, with the notable exception of a climber spotting another climber.
7. All signs and instructions must be followed.
8. Exceeding established height limits is prohibited.
9. Each User must treat other Users with respect and refrain from taking risks that could cause injury to themselves or others.
10. Anyone on the ground must ensure they remain out of the potential fall path of individuals practicing bouldering.
11. Before jumping off the wall, ensure that the landing area is clear of people and objects.
12. Leaving any objects (bottles, food, bags, phones, etc.) on the mats is prohibited. Only "chalk bags" are allowed on the mats.
13. Running on the mats is prohibited.
14. Climbing holds, climbing volumes, obstacles, and other facilities may become loose, unscrewed, or break, resulting in injury risks. Any damaged items must be immediately reported to the staff.
15. Access to sports facilities is allowed only with clean sports shoes.
16. Modifying climbing holds, climbing volumes, or obstacles is prohibited. Any damaged items must be immediately reported to the staff.
17. Access to closed sectors due to restructuring is prohibited.
    

F. Children / Minors

1. The legal guardian expressly assumes full responsibility for the minor’s compliance with these regulations and for any damage caused by the minor.
2. A legal guardian must sign the membership application and the internal regulations for any minor.
3. Each minor above the age of 12 must be accompanied by a legal guardian during their first registration and the safety briefing. The legal guardian must sign a declaration of consent and explain the internal regulations to the minor. Subsequently, minors above 12 years old have the right to use the sports facilities without adult supervision.
4. Children under 12 are only allowed in areas specifically designated for their age group in the Adventure zone.
5. Children under 12 are not allowed to frequent and use the Bouldering zone and the fitness facilities.
6. Children under 12 must be always accompanied and supervised by a legal guardian or another responsible adult. The supervision ratio is 1 adult to 2 children.
7. Children aged 6 to 11 may exceptionally access the Bouldering Zone if they hold a valid BoulderForest Bouldering Passport or demonstrate an equivalent level of experience, competence and understanding of the applicable safety rules to the satisfaction of BoulderForest staff. Access must be explicitly authorized by BoulderForest staff. Children aged 6 to 11 must remain accompanied and supervised by a legal guardian or another responsible adult at all times. BoulderForest reserves the right to restrict or withdraw such access if the applicable safety rules or staff instructions are not respected.
8. Playing and running are prohibited in all bouldering fall zones (grey-carpeted areas), including those located within the Adventure Zone. Playing and running are permitted in the Adventure Zone outside these grey-carpeted areas.
9. Minors participating in a group (birthday party, after-school care, daycare, school, etc.) are only allowed under the supervision of a responsible adult. The adult supervisor must sign a declaration of consent in advance.
   

G. General Terms of Sale

1. All purchases made are considered final. BoulderForest payments are non-refundable except in duly justified cases, including force majeure or medical incapacity, subject to supporting documentation and BoulderForest’s assessment.
2. Prices may be subject to adjustments over time. Any price variation will apply only to new monthly subscriptions, course cards, individual course purchases, events, and programs purchased at that time.
3. All subscriptions (monthly, courses, events, and programs) are nominative and non-transferable.
4. Memberships (entrances, monthly subscriptions, courses, single courses, events, programs, room rental, etc.) cannot be shared. Anyone found sharing their membership will be denied access and will permanently lose their subscription, course card, and access to any other course or event.
5. It is the responsibility of the User to settle any unpaid participation for a BoulderForest course or event. BoulderForest reserves the right to suspend the membership of the User until the unpaid participation (and/or negative balance) is settled.
6. To register or make a purchase via the online booking system, the User must be eighteen (18) years of age or older. Registrations and courses for children and teenagers must be purchased by a legal representative aged eighteen (18) or older on behalf of the child or teenager.
7. The User must ensure that the information provided during registration or at any time is accurate and complete.
8. Registrations and reservations for classes, rooms and events (including birthday parties and teambuilding events) are binding. Reservations may be rescheduled free of charge up to 7 days before the scheduled date. In case of cancellation at least 7 days before the scheduled date, a voucher for the full amount paid will be issued. Cancellations or changes made less than 7 days before the scheduled date, as well as no-shows, are not eligible for a voucher, refund or rescheduling.
9. If any provision of these terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10. These terms are governed by Luxembourg law. Any dispute shall fall within the jurisdiction of the courts of Luxembourg.
11. Any incident, accident, or damage must be reported immediately to BoulderForest staff.
    

H. Insurance

1. BoulderForest maintains civil liability insurance covering its activities in accordance with applicable legal requirements. Users are strongly encouraged to obtain their own personal insurance coverage, including civil liability and personal accident insurance, appropriate for the practice of climbing and related activities.
2. The User acknowledges that BoulderForest’s insurance does not replace or substitute the User’s own insurance coverage.
3. The User undertakes to mobilise their own insurance coverage in priority for any damage or injury suffered or caused in connection with the use of the facilities, without prejudice to any rights they may have under the applicable law.
4. Any accident, injury, damage, or unsafe condition occurring within the facility must be reported immediately to BoulderForest staff. Failure to report an incident without undue delay may affect the handling of any related claim.
5. BoulderForest reserves the right to document and investigate any reported incident and to take appropriate measures to ensure the safety of Users.
6. Any claim arising from the use of the facilities must be notified to BoulderForest in writing within a reasonable period following the occurrence of the incident and in any event within eight (8) days, unless prevented by force majeure. The User agrees to cooperate in good faith with any investigation relating to such a claim.
